Welcome to TommyRausch.com. These Terms & Conditions (“Terms”) govern your use of TommyRausch.com (the “Website”) and your purchase of artwork, prints, canvases, and other products offered through the Website.
By accessing the Website or placing an order, you agree to these Terms. Please read them carefully before making a purchase.
1. ABOUT TOMMYRAUSCH.COM
TommyRausch.com is the official online portfolio and storefront for artwork by artist Tommy Rausch.
The Website features original artwork, fine-art reproductions, canvas prints, limited-edition works, open-edition works, and other artist-created products.
Certain artwork or collections may also relate to or incorporate technology, experiences, or creative projects developed by Tommy Rausch through ANIM8TED™, The Art of Sound™, or affiliated creative projects. Unless specifically stated on an individual product page, purchasing artwork from TommyRausch.com does not automatically include access to an ANIM8TED digital experience.
2. ARTWORK & PRODUCT IMAGES
Every effort is made to represent artwork accurately on the Website. However, colors, tones, textures, proportions, and other visual characteristics may appear differently depending on your device, monitor, screen settings, lighting, and the materials used in production.
Product photographs, room mockups, framed-art simulations, lifestyle images, and other promotional images may be used to demonstrate how artwork could appear when displayed. These images are illustrative and may not represent exact scale, framing, surroundings, or color.
Please review the dimensions and product specifications provided on each product page before ordering.
3. MADE-TO-ORDER ARTWORK
Many canvas and fine-art products sold through TommyRausch.com are individually produced after an order is placed.
Because these pieces are made to order, production begins specifically for your purchase.
Unless otherwise stated on the applicable product page, made-to-order canvas artwork typically arrives within approximately 5–8 business days after production begins. Delivery times are estimates and are not guaranteed.
Production and delivery may occasionally take longer because of order volume, carrier delays, holidays, weather, material availability, or other circumstances outside our reasonable control.
4. PRICING & PAYMENT
All prices are listed in U.S. dollars unless otherwise stated.
Prices, product availability, edition availability, promotions, and specifications may change without notice.
Applicable sales tax and shipping charges, if any, will be calculated during checkout.
Payment must be successfully processed before an order enters production or ships.
We reserve the right to cancel or refund an order resulting from an obvious pricing, inventory, technical, or listing error.
5. LIMITED EDITIONS
Artwork identified as a Limited Edition is produced in the edition quantity stated on the applicable product page.
Where applicable, limited-edition artwork may be individually numbered, signed, accompanied by a certificate or other edition documentation, or otherwise identified as described in the product listing.
Edition sizes apply only to the particular product, size, medium, or variation identified in the listing unless expressly stated otherwise.
Artist proofs, exhibition proofs, prototypes, master works, originals, alternate sizes, alternate mediums, or other artist-retained versions may exist separately from a numbered edition unless the product description specifically states otherwise.
6. OPEN EDITIONS
Artwork identified as an Open Edition is not restricted to a predetermined production quantity.
Open-edition artwork may continue to be produced and sold for as long as the artist chooses to make the work available.
The artist may discontinue, modify, resize, reformat, reissue, or otherwise develop an open-edition work at any time.
7. ORIGINAL & HAND-EMBELLISHED ARTWORK
Original, one-of-one, master, or hand-embellished works may contain intentional variations, textures, markings, brushwork, surface characteristics, or other handmade elements.
These characteristics are part of the individual nature of the artwork and should not be considered manufacturing defects.
Where a work is identified as 1 of 1, that designation applies to the specific physical artwork described in the product listing.
8. SHIPPING
Customers are responsible for providing complete and accurate shipping information.
We are not responsible for delays or failed deliveries resulting from incorrect addresses supplied by the customer.
Once an order has been transferred to a shipping carrier, delivery is subject to the carrier's operations and policies.
If artwork arrives visibly damaged, please retain the original packaging and contact us promptly with photographs of the artwork, packaging, and shipping label so the issue can be evaluated.
9. RETURNS, CANCELLATIONS & DAMAGED ORDERS
Because many artworks are made specifically for each customer, made-to-order artwork may not be eligible for return or cancellation once production has begun, except where required by applicable law or where the product arrives damaged, defective, or materially different from what was ordered.
Limited-edition, signed, numbered, personalized, custom, original, and one-of-one artwork may be designated as final sale.
If you receive an incorrect, damaged, or defective item, please contact us promptly after delivery so that we can review the issue.
Any return or replacement must be authorized before artwork is shipped back.
Additional return or refund terms displayed on an individual product page or in a separate Return Policy form part of these Terms.
10. INTELLECTUAL PROPERTY
Unless otherwise stated, all original artwork, illustrations, designs, compositions, photographs, graphics, logos, product designs, written content, videos, animations, creative concepts, and other original materials appearing on TommyRausch.com are owned by or licensed to Tommy Rausch and/or the applicable affiliated entity and are protected by applicable intellectual-property laws.
Purchasing physical artwork does not transfer copyright or other intellectual-property rights to the purchaser.
Ownership of a physical artwork gives the purchaser ownership of that physical object only.
Artwork may not be copied, reproduced, scanned, photographed for commercial reproduction, distributed, modified, published, minted as a digital asset or NFT, used to train or develop artificial-intelligence systems, incorporated into merchandise, commercially displayed, licensed, or otherwise commercially exploited without prior written permission from the applicable rights holder.
11. PERSONAL DISPLAY
Unless otherwise stated, artwork purchased through TommyRausch.com is intended for personal display and enjoyment.
Purchase of artwork does not constitute permission to use the image or artwork for advertising, merchandise, branding, promotional campaigns, commercial reproductions, digital products, or other commercial purposes.
